1. General

Introduction

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the Remember Your People Web App (the "Service") operated by Websightful UG ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

2. Use of the Service

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the authenticity, correctness, and propriety of that information.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Websightful UG.

Websightful UG has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Websightful UG shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

3. Payments and Access

Payments

The payments are done via our reseller and Merchant of Record Paddle.com. We do not store any sensitive payment data like credit card numbers and expiration dates, however this information might be saved at the payment providers.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

4. Data and Privacy

Data Processing Agreement (DPA)

Roles of the Parties. For the purposes of applicable data protection laws, including the General Data Protection Regulation (GDPR):

• You (the user) act as the data controller for any personal data you enter, store, or manage using the Service.
• Websightful UG acts as a data processor, processing such data solely on your behalf and according to your instructions.

Scope of Data Processing. Websightful UG processes user-entered data only for the purpose of providing and operating the Service, including:

• Storing and retrieving data as instructed by the user;
• Securing the data against unauthorized access;
• Enabling backups, exports, and deletions initiated by the user.

We do not access, analyze, sell, or otherwise use user-entered data for our own purposes.

Security, Confidentiality, and Sub-processors. Websightful UG implements appropriate technical and organizational measures to protect user data. Access is restricted to what is strictly necessary for service operation. We may use carefully selected third-party sub-processors (such as hosting providers) who are bound by consistent data protection obligations.

Data Deletion and Portability. Users may delete their data or their entire account at any time. Upon account deletion, user data will be removed from active systems within a reasonable period, except where retention is required by law. Users may also export their data using the tools provided by the Service.

User Responsibility for Entered Data

You are solely responsible for:

• Ensuring that you have the right and legal basis to collect, store, and process any personal data you enter into the Service;
• The accuracy, lawfulness, and appropriateness of such data;
• Complying with any obligations toward data subjects whose data you store (including informing them, where required by law).

Websightful UG does not verify, monitor, or control the content of data entered by users and does not determine the purposes for which such data is processed. All data entered remains the property of the user; this Agreement does not grant us ownership or usage rights beyond what is necessary to operate the Service.
